Whistle, a brand name of Star Smile Technologies Private Limited (referred to as “we”, us”, “our”, “Whistle”) is the author and publisher of the internet resource www.whistle.in (“Website”) on the world wide web as well as other software and applications provided by Whistle, including but not limited to the mobile applications (referred to as “App”, and together with Website referred to as “Services”). (The term ‘we’ or ‘us’ or ‘our’ or ‘Whistle’ wherever used shall include the affiliates or business/ Partner Clinics of Whistle (“Partner”)).

Information that is freely available in the public domain or accessible under the Right to Information Act, 2005 or any other law will not be regarded as personal information or sensitive personal data or information.
3.2All the information provided to us by a User, including sensitive personal information, is voluntary. You understand that Whistle, either itself or with its Partners, may use certain information of yours, which has been designated as ‘sensitive personal data or Information’ under the SPI Rules,(A) for the purpose of providing you the Services, (B) for commercial purposes and in an aggregated or non- personally identifiable form for research, statistical analysis and business intelligence purposes, (C) for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to our Partners. Whistle also reserves the right to use information provided by or about the User for the following purposes:
a) Publishing such information on the Website.
b) Contacting Users for offering new products or services.
c) Contacting Users for taking product and Service feedback.
d) Analyzing software usage patterns for improving product design and utility.
You hereby consent to such use of such information by Whistle and our Partner.
We may also disclose or transfer your personal information and sensitive personal data or information to another third party as a part of reorganisation or a sale of our assets or of our business to such third party. Any third party to which we transfer or sell our assets to, will have the right to continue to use such personal information and sensitive personal data or information.

3.4 If your personal information changes, you may access, correct, delete inaccuracies, or amend information by making the change on your profile information page on the Websites or App or by contacting us at https://whistle.in/contact/ . We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. You agree and acknowledge that in respect of any sensitive personal data or information which cannot be corrected or amended pursuant to any applicable law, law enforcement requests or judicial proceedings or the like, the aforementioned rights will not be available.

However, please note that withdrawal of consent will not be retrospective in nature and shall be applicable prospectively. In case you do not provide your personal information or consent for usage of sensitive personal data or information or subsequently withdraw your consent for usage of the sensitive personal data or information so collected, we reserve the right to discontinue the services for which the said information was sought.
3.6 In order to have access to all the features and benefits on our Website or App, a User must first create an account on our Website or App. To create an account, a User is required to provide the following information, which such User recognizes and expressly acknowledges is personal information allowing others, including Whistle, to identify the User: name, User ID, email address, address, date of birth, gender, phone number and password chosen by the User. Other optional information may be requested on the registration page. We may, in future, include other optional requests for information from the User to help us to customize the Services to deliver personalized information to the User. However, We assume your consent in relation to various matters, once you complete the registration process.
3.9 Our Websites and the App may include social media Features, such as the Facebook or Instagram or Twitter button. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Your interactions with these Features are governed by the privacy statement of the company providing them.
3.10. Whistle has implemented best international market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Whistle or its Partners shall not be held liable for any loss whatsoever incurred by the User.
a) belongs to another person and to which you do not have any right;
b) is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
c) is harmful to children;
d) infringes any patent, trademark, copyright or other proprietary rights of third parties;
e) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature or, in respect of any business of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as the Ministry may, by notification published in the Official Gazette, specify;
f) impersonates another person;
g) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence, or prevents investigation of any offence, or is insulting other nation;
h) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
i) is in the nature of an online game that is not verified as a permissible online game;
j) is in the nature of advertisement or surrogate- advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game; or
k) violates any law for the time being in force.

4.2. We reserve the right to terminate your account without any prior notice if you are found to be hosting, posting, displaying, uploading, modifying, publishing, transmitting, storing, updating or sharing Prohibited Content.
4.3. Further, you acknowledge and agree that we reserve the right to, and may from time to time, monitor and take down any and all content transmitted or received through the Website and / or App, as required under applicable law.
5.1. Your Personal Information is maintained by Whistle in electronic form on its or its employees and Partners equipment. Such information may also be converted to physical form from time to time. We take necessary precautions to protect your personal information both online and off-line and implement reasonable security practices and measures including certain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of Whistle’ business.
5.2. It is important for you to protect against unauthorized access to your password, your computer and your mobile phone or device. Be sure to log off from the Website when finished. Whistle and its Partners do not undertake any liability for any unauthorized use of your account and password. You shall be liable to indemnify Whistle, its employees and Partners due to any loss suffered by them due to such unauthorized use of your account and password.
5.3. Whistle makes all User information accessible to its employees only on a need-to-know basis.

Notwithstanding the above, Whistle is not responsible for the confidentiality, security or distribution of your personal information by our Partners and third parties outside the scope of our agreement with such Partners and third parties. Further, Whistle and its Partners shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of Whistle and its Partners including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.
6.2. If a User uses the Services or accesses the Website or uses the App after a notice of changes has been sent to such you or published on the Website or App, you hereby provide your consent to the changed terms.
